ALLEGED MANSLAUGHTER.

Carl Marie Gradman, was charged on remand with causing the death of Caroline Laurvig.

Mr Lee defended the prisoner.

Edward Anderson LAURVIG, a storekeeper at Norsewood, and husband of the deceased, said that on the 29th of June his wife was confined with twins. A nurse named Mrs STAAKI was present. After the first child was born the nurse told him to fetch a doctor, and he went for Mr GRADMAN who was "a kind of doctor, helping people when they were ill." Mr GRADMAN told him that he had better get an English doctor, and he said he would do so , but pressed him (GRADMAN) to go to the house. This he consented to do, but on seeing Mrs LAURVIG he told witness to go at once for the doctor. This would be between four and five o'clock in the morning, or about an hour and a half after GRADMAN arrived. Witness was about an hour and a half catching his horse, but he then rode off to Kopua, and caught the train for Waipukurau, where he found Dr REED. They returned by the next train, and Dr REED rode from Kopua on horseback, witness following in the coach. On his arrival at home he found Dr REED there; the child was born, and Mrs LAURVIG appeared to be all right. After the doctor left she seemed to improve up to midnight, when she became worse, dying about 5 o'clock in the morning. When she died a neighbor named Mrs GUNDERSON was with her. Mrs STAAKI remained with her until 4 o'clock, when she went to lie down in another room.

Anna STAAKI, wife of Harold STAAKI, said she was living with Mrs LAURVIG for five or six weeks before her death. She was engaged to assist in the housework - not as a nurse. She had before acted as nurse on similar occasions, and when Mrs LAURVIG was taken ill witness attended to her at the birth of her first child, when, seeing that all was not right, she told Mr LAURVIG to go for assistance. When Dr GRADMAN came witness went to lay down, leaving Mrs ERICKSON in the room with him.

Mrs ERICKSON gave evidence of a similar nature to that of the last witness. She was present when the first child was born, and also while GRADMAN was attending to Mrs LAURVIG. She described at length GRADMAN's treatment.

Dr. REED, of Waipukurau, gave evidence of the state in which he found the deceased. When the other child was born he noticed that both arms had been torn away, which would be the effect of GRADMAN's procedure as described by the last witness. The child was of course dead. He remarked this at the time, but could get very little explanation from those present. He left Mrs LAURVIG free of pain and comortable, but he had a doubt of her recovery. Her death he attributed to exhaustion. He believed that if she had been attended by a skilled medical man at first she would have lived.

Mr KENNY asked the witness whether he thought that, had the accused not attended Mrs LAURVIG - that was, had she been left without medical attendance until his (Dr REED's) arrival - she would have recovered?

Dr. REED replied he was not prepared to say that. All he could say was that he believed that if she had been skillfully attended at first she would have recovered.

Mr KENNY said that there was no direct evidence to show that Mrs LAURVIG's death was due to the unskilful treatment of the accused, and if he were committed for trial no jury would convict him. He (Mr KENNY) should therefore discharge him from custody."
